Terms and Conditions

1. About SendAChoice
These Terms and Conditions (“Terms”) govern your access to and use of the SendAChoice platform operated at sendachoice.com (“Platform”) and any associated services. By purchasing, sending or redeeming a curated collection, you confirm you have read, understood and agree to these Terms, along with our Privacy Policy.
SendAChoice operates as an independent gifting and procurement facilitation platform. We are not affiliated with, endorsed by, partnered with, or authorised resellers of any third-party brands whose products may appear within our collections. References to brand or product names are used solely for descriptive purposes to indicate the type of products that may be sourced.
2. Nature of the Service
SendAChoice provides a digital gifting facilitation service. When you purchase a curated collection:
- You are purchasing a procurement and fulfilment service, not a branded financial instrument or stored value product
- The recipient selects products from a curated category-based collection
- SendAChoice then sources and procures those products on behalf of the recipient through our supplier network
- We act as a procurement agent — sourcing items to fulfil a recipient's expressed selection
- We do not hold stock, operate as a traditional retailer, or claim any official brand relationship
This model is fundamentally distinct from the sale of branded gift cards, stored value instruments or prepaid vouchers issued by or on behalf of any specific brand.
2A. Binding Effect on Recipients
These Terms bind both the buyer (the person who purchases a SendAChoice collection) and the recipient (the person who receives and redeems a collection link), regardless of whether the recipient:
- was a party to the original purchase transaction
- actively signed, ticked, or otherwise acknowledged these Terms in advance
- read these Terms before accessing or redeeming their collection link
By accessing a SendAChoice collection link, browsing a collection, making any product selection, or submitting a delivery address, the recipient is deemed to have read, understood and accepted these Terms in full. The act of redemption constitutes acceptance.
Where a buyer sends a collection on behalf of a corporate entity, the buyer is responsible for directing recipients to these Terms. Failure to do so does not affect the binding nature of these Terms on the recipient — access and use of the collection link constitutes independent acceptance by the recipient.
If a recipient does not agree to these Terms, they should not access or redeem their collection link and should notify the buyer accordingly.
3. No Brand Affiliation or Endorsement
SendAChoice operates entirely independently of any brands referenced on the Platform. Specifically:
- We are not an authorised reseller, licensee or partner of any brand featured in our collections
- Brand names are used in a purely descriptive, nominative capacity to indicate the category and nature of products that may be sourced
- No brand has endorsed, sponsored or approved SendAChoice's collections or services
- Product availability is subject to change without notice based on supplier availability
- Actual products sourced may vary from those described while remaining within the stated category and quality tier
4. Eligibility
You must be at least 18 years old to purchase a collection. By purchasing, you confirm this. Corporate account holders confirm they have authority to bind their organisation to these Terms. Recipients confirm they are 18 or over by accessing a collection link. Age-restricted products (including alcohol) may only be selected and received by persons of legal age in their jurisdiction. SendAChoice reserves the right to cancel fulfilment where there are reasonable grounds to believe an age-restricted product is being redeemed by a minor.
5. Purchasing a Collection
When you complete a purchase, you are paying for a procurement facilitation service for a recipient to select products up to a specified value within a curated category. You are not purchasing any specific product, brand voucher, or stored value instrument at the point of sale.
All prices include applicable taxes unless stated otherwise. Payment is taken in full at purchase. Once confirmed, your recipient receives a personalised digital collection link.
Collection value and buyer representations. The collection value is fixed at the amount paid by the buyer. SendAChoice bears no responsibility for any representation a buyer makes to a recipient about the value, contents or nature of a collection that exceeds or differs from what was actually purchased. Our obligation to the recipient is limited to the collection value as confirmed on the Platform at the time of purchase.
6. Collection Links, Redemption and Link Security
Collection links are personal to the named recipient and non-transferable. We reserve the right to deactivate links we have reasonable grounds to believe are being misused or transferred without authorisation.
By accessing a collection link, the recipient is bound by these Terms in accordance with Section 2A. Recipients are advised to read these Terms before making any selection.
Link security is the recipient's responsibility. Once a collection link is issued, it is the recipient's responsibility to keep it secure. Where a link is accessed by a third party as a result of the recipient sharing, forwarding or failing to secure it, SendAChoice's fulfilment obligation is discharged upon redemption from any device presenting the valid link. We do not investigate which individual used a link to redeem — redemption by any party constitutes valid redemption. No replacement collection or refund will be issued where a link has been redeemed by a person other than the intended recipient as a result of recipient conduct.
Product descriptions, specifications and images presented during the selection process are indicative representations, not contractual guarantees of exact specification, availability or price. The authoritative position on all product matters is that of the fulfilling Partner at the time of procurement — see Section 10.
Once a recipient confirms product selections, procurement commences and selections cannot be changed. Recipients should review all product details carefully before confirming, understanding that fulfilled specifications may differ from what is displayed where a Partner has confirmed a different specification at the applicable price point.
Fraudulent or unauthorised purchase. Where SendAChoice has reasonable grounds to believe a collection was purchased through fraud, use of stolen payment credentials or any other unauthorised means, we reserve the right to deactivate the collection link and cease fulfilment at any point — including after partial redemption. SendAChoice bears no liability to a recipient whose collection is deactivated on these grounds. Affected recipients should contact the person who sent them the collection link.
7. Delivery
All physical fulfilment is governed by our Delivery Terms and Conditions, which form part of these Terms by reference and should be read alongside them. The Delivery Terms are the authoritative document on all matters relating to:
- delivery address responsibility and errors
- missed delivery and redelivery costs
- carrier confirmed delivery
- transit damage
- perishable and time-sensitive items
- international delivery, customs and import duties
- restricted jurisdictions
- tracking
- failed, delayed or missing deliveries
- returns and resolution of delivery disputes
Delivery timeframes vary from 3 to 30 days depending on product, sourcing route and recipient location. SendAChoice is not liable for delays outside our reasonable control.
8. Cancellations, Refunds and Collection Value
Before redemption: Refund requests may be made within 30 days of purchase by contacting support@sendachoice.com, provided the collection link has not been accessed or redeemed.
After redemption: Once a recipient has confirmed product selections, procurement has commenced and no refund is available for the collection value.
Defective or incorrect items: Contact us within 14 days of receipt with your order reference and photographs. We will arrange replacement or resolution at our discretion. Subjective dissatisfaction with a product's quality, taste, aesthetic, size or personal appeal does not constitute a defect and is not grounds for a refund or replacement. The applicable standard is objective defect — meaning the item is damaged, materially incorrect, or genuinely not as described — not personal preference.
Partial redemption: No refund is issued for unused collection value where a recipient selects products totalling less than the full collection value. Recipients are not entitled to receive the difference in cash, credit or any other form.
No cash equivalent: Collection value has no cash redemption option under any circumstances. It cannot be exchanged for cash, bank transfer, cryptocurrency, store credit with any third party, or any other monetary instrument. The only form of redemption is selection of available products through the Platform.
Collection value expiry: Where a collection link remains unredeemed for a period of 12 months from the date of issue, SendAChoice reserves the right to treat the collection value as lapsed and to reclaim it. For corporate campaigns, the unredeemed budget return period is 90 days from campaign close, as agreed at the time of purchase. In either case, SendAChoice will make reasonable efforts to notify the buyer before expiry. Expired collections will not be reinstated.
Promotional and discounted collections: Where a collection is purchased at a promotional price, through a discount code, or during a sale event, the collection value is fixed at the price paid — not the undiscounted price. Promotional pricing does not stack with other offers, can be withdrawn at any time without notice, and confers no additional collection value above what was confirmed at purchase.
9. Corporate, Bulk Orders and B2B Payment Obligation
Corporate accounts are subject to additional terms agreed at onboarding. Corporate senders are responsible for ensuring their recipients are directed to these Terms prior to redemption.
Payment is a condition of fulfilment. In B2B transactions, SendAChoice's obligation to fulfil collections is conditional on cleared payment from the corporate buyer. Where a corporate buyer's payment is disputed, reversed, delayed or otherwise not received in cleared funds, SendAChoice reserves the right to suspend or deactivate collection links associated with that purchase pending resolution. Recipients whose collections are suspended for this reason should contact the buyer — SendAChoice bears no liability to recipients for suspensions arising from the buyer's payment failure.
Buyer responsibility for recipient conduct. The corporate buyer is responsible for distributing collection links appropriately and at the correct time. Where a link is distributed prematurely, to the wrong person, or in circumstances that lead to unintended redemption, the buyer bears the consequences. SendAChoice's obligation is discharged upon valid redemption of the link, regardless of whether the redemption was intended by the buyer.
10. Product Sourcing, Partner Authority and Fulfilment
SendAChoice operates through a network of third-party supply chain partners, distributors, aggregators and fulfilment providers (collectively, “Partners”). Once a recipient confirms product selections, fulfilment is carried out by these Partners — not directly by SendAChoice.
Partner confirmation is final and authoritative. In all matters relating to stock availability and quantity, product specifications (including size, weight, volume, colour, variant or configuration), the price at which a product can be procured at the time of fulfilment, and lead times and delivery windows — the confirmed position of our Partner governs. SendAChoice accepts no liability for any discrepancy between what a Partner confirms and what a recipient may have encountered on the Partner's own website, on third-party retail platforms, in-store, or through any other channel.
No price-matching obligation. The value loaded on a collection reflects a procurement budget, not a price guarantee against any external market. SendAChoice makes no representation that prices at which products are procured will match, be comparable to, or be lower than prices available to consumers directly through any brand's own channels, through online retailers, or elsewhere. Partner-confirmed procurement prices are the operative prices for fulfilment purposes.
Product specifications are indicative. Product descriptions, images, sizes, volumes, weights and specifications displayed during the selection process are provided in good faith as representations of what may be available, but are not contractual guarantees of exact specification. The authoritative specification is the one confirmed by the fulfilling Partner at the time of procurement. Where a Partner confirms a different specification — for example, a different size, volume or configuration from that displayed — that Partner-confirmed specification is what will be fulfilled.
By way of illustration and not limitation: if a recipient selects a product described as 600ml and the fulfilling Partner confirms that the product is available at the applicable price point in a 200ml configuration only, the 200ml product will be fulfilled. This does not constitute a breach of these Terms, a misrepresentation, or grounds for a refund of the collection value.
Product images are illustrative only. Images, renders and photography used on the Platform — including product images presented during the selection process — are illustrative representations only. They do not guarantee exact colour, finish, packaging, presentation, quantity, dimensions or any other visual characteristic of the item that will be fulfilled. The fulfilled item may differ in appearance from the image displayed while remaining within the correct product category and specification as confirmed by the Partner.
Seasonal, limited edition and promotional products. Where a product is displayed on the Platform as part of a seasonal range, limited edition release or promotional offer, its availability is not guaranteed at the time of fulfilment. Such products may be withdrawn, replaced or unavailable without notice. Where a seasonal or promotional product is no longer available at the time of procurement, Section 10 substitution provisions apply.
Product discontinuation. Where a product is discontinued by its manufacturer or brand between the time of selection and fulfilment, SendAChoice will treat it as unavailable and apply the substitution provisions below. Discontinuation is outside SendAChoice's control and does not give rise to a claim against us beyond the resolution process set out in this Section.
Substitution. Where a selected product is confirmed as unavailable by a Partner:
- We will offer the recipient an alternative of equivalent category and quality tier
- If no suitable alternative is available, we will arrange an appropriate resolution at our discretion, which may include a credit to the collection or a partial refund
- Product substitution does not constitute a breach of these Terms
Returns to brands or retailers. Items procured through SendAChoice cannot be returned directly to the brand, retailer or any third-party store. The supply chain through which items are procured means the brand has no record of a direct consumer sale and will be unable to process a return. All complaints, return requests and resolution requests must be directed to SendAChoice at support@sendachoice.com. We will manage any resolution through our Partner network.
Authenticity. SendAChoice sources products in good faith through our Partner network. We make no independent warranty of product authenticity beyond the representations made to us by our Partners. Where a recipient has genuine grounds to believe a product is not authentic, they should contact us within 14 days of receipt with evidence. We will investigate through our Partner network and take appropriate action. SendAChoice is not liable for Partner representations regarding authenticity that subsequently prove inaccurate, beyond taking reasonable steps to rectify the position.
Digital products and experiences. Where the catalogue includes digital products (such as subscription codes, digital downloads or streaming credits) or experience-based products (such as vouchers for services, events or activities), the terms and validity of those products are governed by the issuing third party, not SendAChoice. We make no warranty regarding the functionality, validity period, geographic availability or terms of any third-party digital or experience product. Complaints regarding third-party digital products must be raised first with SendAChoice, who will assist where reasonably possible but accept no liability for third-party product failures or changes to third-party terms.
No liability for Partner conduct. SendAChoice is not responsible for the acts, omissions, errors or delays of Partners in the fulfilment of orders. Our obligation is to instruct fulfilment in good faith through our Partner network. Where a Partner fails to fulfil or fulfils incorrectly, our liability is limited to taking reasonable steps to rectify the position — it does not extend to consequential loss, distress or any claim beyond the face value of the affected collection.
11. Platform Availability and Technical Issues
SendAChoice makes reasonable efforts to keep the Platform available and operational. However, we do not guarantee uninterrupted availability. The Platform may be subject to planned maintenance or unplanned downtime.
Platform downtime does not extend collection expiry. If the Platform is unavailable during a period in which a recipient intended to redeem, this does not automatically extend the collection expiry date. Recipients experiencing technical difficulties should contact us promptly at support@sendachoice.com and we will consider extensions on a case-by-case basis at our discretion.
Technical errors during redemption. Where a recipient submits a selection multiple times due to a technical fault (for example, a dropped connection mid-checkout), and this results in a duplicate or unintended order, SendAChoice will make reasonable efforts to cancel the duplicate before procurement commences. We cannot guarantee cancellation once procurement has begun and accept no liability for duplicate orders arising from recipient-side technical issues, including unstable internet connections, browser errors or device failures.
SendAChoice accepts no liability for loss or damage arising from Platform unavailability, data loss, security breaches not caused by our negligence, or third-party service interruptions affecting our Platform.
12. Intellectual Property and Buyer-Uploaded Content
All Platform content — collection names, copy, design, software and brand elements — is owned by or licensed to SendAChoice. You may not reproduce or create derivative works from Platform content without our prior written consent. Third-party brand names referenced on the Platform remain the property of their respective owners.
Buyer-uploaded content. Where buyers upload logos, brand assets, images, messages or other content to the Platform for use in branded collections, personalised cards or campaign materials, the buyer warrants that they own or have all necessary rights and licences to use that content and to authorise SendAChoice to use it for fulfilment purposes. SendAChoice accepts no liability for intellectual property infringement arising from buyer-uploaded content. The buyer agrees to indemnify SendAChoice against any claim arising from content they upload.
13. Acceptable Use and Abuse of the Platform
You agree not to use the Platform for unlawful purposes, attempt to circumvent security measures, use automated tools to scrape or access the Platform, commercially resell or transfer collection links, impersonate SendAChoice or other users, or engage in conduct that damages the Platform or our reputation.
Abuse of the complaints process. SendAChoice operates a complaints process in good faith. We reserve the right to reject, close or decline to escalate complaints where there is evidence of bad faith, including but not limited to: raising complaints after successful redemption and receipt of goods with the intention of obtaining a refund while retaining the items; submitting materially false or exaggerated claims; raising disputes across multiple orders in a pattern inconsistent with genuine grievance; or seeking to use the complaints process as leverage for goods or value to which the complainant is not entitled.
Consequences of abuse. Where SendAChoice identifies a pattern of abuse — whether by a buyer, a recipient or a party acting in concert with either — we reserve the right to: reject the complaint without resolution; deactivate outstanding collection links associated with the relevant account; refuse future service; and pursue recovery of any value obtained through bad faith claims. Referral to law enforcement or legal proceedings may follow in cases of fraud.
We may suspend or terminate accounts that breach these conditions without notice.
14. Disclaimer of Warranties
The Platform and services are provided “as is.” To the fullest extent permitted by law, SendAChoice makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.
We make no warranty regarding the corporate conduct, ethical practices, environmental record or values of any brand referenced on the Platform. Inclusion of a brand in our collections does not constitute an endorsement of that brand's conduct. Personal, ethical or political objections to a brand's inclusion in a catalogue are not grounds for a refund, substitution or complaint resolution.
15. Limitation of Liability
To the fullest extent permitted by law, SendAChoice is not liable for indirect, incidental, consequential or punitive losses; loss of profits, revenue or data; or business interruption. Our total aggregate liability for any order shall not exceed the value of that order. Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraudulent misrepresentation.
16. Indemnification
You agree to indemnify and hold harmless SendAChoice, its directors, employees and agents from any claims, losses, damages or expenses (including reasonable legal fees) arising from: your use of the Platform; your breach of these Terms; your violation of any third-party rights; any content you upload to the Platform; or any representation you make to a recipient about a collection that is not consistent with what was purchased.
17. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, war, civil unrest, strikes, customs delays, carrier disruption, pandemic-related restrictions, government action, or supplier failure. Where such an event affects an order, we will communicate proactively and take reasonable steps to minimise disruption once the event has passed.
18. Currency and Exchange Rates
Collection values are denominated in the currency stated at the time of purchase. Where products are sourced cross-border, SendAChoice uses exchange rates as determined by our Partners and payment processors at the time of procurement. These rates may not reflect the mid-market rate or the rate a recipient may have used to estimate product value in their local currency.
SendAChoice makes no warranty regarding currency equivalence and accepts no liability for any perceived shortfall in value arising from exchange rate fluctuation between the time of purchase and the time of fulfilment. Collection value is fixed in the purchase currency and the procurement outcome in any other currency is subject to prevailing rates at the time of sourcing.
19. Third-Party Rights
These Terms do not create any rights enforceable by third parties under the Contracts (Rights of Third Parties) Act 1999 or otherwise, except that Partners may rely on the provisions of Section 10 to the extent those provisions limit their liability through SendAChoice.
20. Dispute Resolution
If you have a complaint, contact us first at support@sendachoice.com. We aim to resolve complaints within 10 business days. Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales and governed by English law. EU/EEA consumers retain rights to alternative dispute resolution in their jurisdiction.
Any dispute relating to the actions, omissions or representations of a Partner in the fulfilment of an order is subject to the dispute resolution process set out in this Section and cannot be pursued independently against the Partner by the buyer or recipient.
21. Changes to These Terms
We may update these Terms from time to time. The effective date at the top of this page reflects the date of the most recent revision. Material changes will be communicated by email or Platform notice with reasonable advance notice. Continued use of the Platform or redemption of a collection link after the effective date of any revised Terms constitutes acceptance of those revised Terms.
